Privacy Policy

Nestly Realty operates the consumer Platform and is a real estate broker licensed in New York. Nestly Venture LLC ("Nestly Venture") is a separate affiliated company that operates NV Network, the independent-provider marketplace, and administers and funds any NV Buyer Credit program. We may share information with Nestly Venture for those purposes as described below. Nestly Venture's own collection and use of information through its website, marketplace and Buyer Credit administration are also governed by its applicable privacy policy.

Independent service providers have their own privacy practices. The professional Nestly RESM subscription products are separate services and are not governed by this consumer Platform policy unless expressly stated.

Depending on your use of the Platform, we may collect: (a) account and contact details, such as name, email, phone number, address, login credentials and communication preferences; (b) property search preferences, saved properties, location and budget preferences, financing status and other buyer-profile details; (c) transaction details, including tour requests, offers, contracts, status updates, milestones, closing information, messages and documents you upload or authorize us to receive; (d) vendor interactions, such as the providers you view, choose or request to contact, and any requests to invite an outside provider to apply for NV Network participation; (e) business details, licenses, insurance and related information submitted by vendors or prospective vendors; (f) customer-service requests, communications and feedback; and (g) technical information such as IP address, device and browser details, approximate location, session activity, cookies and similar identifiers.

We may also retain records of notices delivered, account approvals, electronic-consent selections, acknowledgments, signatures, document versions and other audit information. Please submit only information relevant to the service you request.

We receive information directly from you and from your use of the Platform. We may also obtain information from Nestly Venture, vendors you select, listing and property-data providers, publicly available records, other transaction participants (such as listing representatives, attorneys, lenders and settlement professionals) and technology or support providers as appropriate for a transaction or authorized request.

We use personal information to operate and secure the Platform; create and manage accounts; support property searches, tours and licensed brokerage services; communicate with you about requests and transactions; organize documents and transaction milestones; enable buyer-authorized vendor contacts; support eligible NV Network and Buyer Credit functions with Nestly Venture; provide customer support; verify disclosures and electronic records; improve functionality; prevent fraud; comply with legal obligations; and establish or defend legal claims.

Where available, automated tools or artificial intelligence may help organize, classify or summarize listing, search or transaction-related information. Such tools may process relevant information for the requested feature, subject to applicable service-provider and privacy safeguards. AI-generated content may be inaccurate and should not be treated as professional advice.

Marketing messages that require separate consent will not be authorized merely because you visit the Website, create an account or acknowledge this Privacy Policy.

We may disclose information to: (a) Nestly Venture, as reasonably needed to operate NV Network, process a specific vendor contact request, invite a provider to participate, verify disclosed Buyer Credit steps or coordinate a credit at closing; (b) the independent vendor you affirmatively select or authorize us to contact, limited to information reasonably relevant to your request; (c) sellers, listing representatives, attorneys, lenders, title or settlement professionals and other transaction participants as reasonably needed for brokerage services and your authorized transaction; (d) companies that provide hosting, analytics, communications, document management, security, customer support and similar services on our behalf under appropriate safeguards; (e) professional advisors, authorities and others when required by law or reasonably necessary to protect rights, prevent fraud or address security incidents; and (f) a successor or acquirer in connection with a lawful business transaction.

We do not sell personal information for money. If advertising or information-sharing activities trigger additional notice or opt-out rights under applicable law, we will provide them. We do not provide your contact details indiscriminately to every marketplace vendor. An independent provider you choose may have separate professional obligations and privacy practices. Do not upload privileged attorney communications or other sensitive material into a shared workspace unless you intend the authorized participants to have access.

NV Network providers may include attorneys, mortgage lenders and brokers, title-related providers, insurers, inspectors, movers, contractors and other legally eligible businesses. These providers are independent, and their collection and use of information are governed by their own policies and professional obligations.

You may use a provider outside NV Network. Only providers accepted by Nestly Venture who complete applicable onboarding and participation requirements may access the Nestly transaction workspace. We may share limited business contact information to invite a provider when you request it. Vendor participation is free at launch; future platform fees or optional advertising, if offered, are matters between Nestly Venture and the provider. The Buyer Credit program has separate eligibility terms and disclosures.

The Website and app may use cookies, mobile identifiers, analytics tools, pixels and similar technologies to support account access, security, preferences, usage measurement, performance and, where implemented, advertising. Certain technology partners may collect technical or usage information as described in their applicable notices.

You can manage some technologies through your browser or device settings and any controls we make available. Where law requires disclosure, consent or an opt-out for particular tracking or advertising activities, we will provide it. The particular tools and controls actually deployed may change and should match the notices presented in the Platform.

We may send necessary account, transaction and service messages through permitted channels. You can opt out of marketing emails using the unsubscribe link and of applicable texts by replying STOP. Promotional calls, texts or other communications requiring separate consent are subject to that consent and applicable law.

You may update information available in your account or contact us to request access, correction or deletion of information, subject to applicable law and requirements to preserve brokerage, transaction, security or legal records. Depending on your state of residence and the laws applicable to us, additional rights or appeal procedures may be available. We may verify your identity before acting on a request.

We maintain administrative, technical and physical safeguards designed to protect information from unauthorized access, loss, misuse and disclosure, as appropriate to the information and our business. No Internet service or storage system can be guaranteed fully secure. We will make notices following a security incident when required by law.

We retain information for as long as reasonably necessary for account and transaction services, brokerage and other legal recordkeeping, Buyer Credit coordination, compliance, audits, security, disputes and legitimate business needs. Retention periods vary by record type. We delete, de-identify or otherwise dispose of information when no longer reasonably needed, subject to applicable retention duties.

Third-party websites, listing-data services and independent vendors may have separate privacy policies. We do not control those practices merely because they are accessible through the Platform. Review their notices before sharing information directly with them.

The Platform is intended for adults age 18 or older and is not directed to children. We do not knowingly collect personal information from children under 13. If we learn such information has been collected, we will take appropriate steps under applicable law.

We may update this Privacy Policy to reflect changes in the Platform, our practices or legal requirements. Material changes will be reasonably communicated through the Platform or another appropriate method. The "Last updated" date identifies the current version. Where law requires renewed consent, we will request it separately.
